BREACH OF CONTRACT CLAIMS & BUSINESS TORTS

The vast majority of business transactions are successful and provide a benefit to both sides. However, sometimes an agreement goes wrong.  If your business has suffered damages because of another party's actions or you have been accused of a business tort, the McCamish Law Firm is here to help. The McCamish Law Firm represents small businesses on both sides of business-tort and breach of contract claims throughout San Antonio and South and Central Texas.  The McCamish Law Firm understands your concerns over a drawn-out and costly legal battle.  Our firm has negotiated numerous settlements that resolve matters for clients quickly, fairly and inexpensively.  At the same time, the McCamish Law Firm is always prepared to go to court to fight for you.

CONSTRUCTION LAW

Construction projects are complicated, and require an abundance of materials, labor, money and other resources to achieve completion.  In construction law, disputes oftentimes arise from construction and design defects that can lead to additional repair costs, diminished property value, and restoration and remediation expenses.  Disputes also arise when a party fails to pay for the labor and materials needed to build the project.  Construction disputes, simple or complex, can arise in any construction project and can be detrimental to your family or business.

The McCamish Law Firm assists property owners, contractors, and subcontractors with all types of disputes arising from residential and commercial construction projects.  Contact the McCamish Law Firm to schedule a consultation regarding your case.

BUSINESS DEVELOPMENT AND CONTRACTS

Texas law lays out the steps you need to follow when starting a business. The McCamish Law Firm will help you through this process step by step, eliminating the chances of a mistake. The firm's business-development services include creation of the business entity, filing the necessary documents with the Texas Secretary of State's Office, development of the partnership agreement, real estate and commercial leases, asset purchase agreement, non-compete agreements, and business dissolution.

Because no two businesses are alike, the firm does not use a one-size-fits-all approach to business development. Instead, we will discuss your goals and the type of business structure makes the most sense for you and your partners.  Once you decide on a business entity, the firm drafts and files the necessary documents, giving you the peace of mind you deserve.

DEBT COLLECTION

The rules of debt collection in Texas are complicated.  State and federal laws like the Fair Debt Collection Practices Act (FDCPA) place several restrictions on collection practices. Even honest businesses often find themselves confused about how and when they are allowed to contact individuals about their unpaid debt. Instead of risking a lawsuit, turn to the McCamish Law Firm.  We have years of experience practicing business law, and can offer useful advice that will minimize your risk of monetary penalties.

For sound, honest legal advice and strong representation related to your business's collection of debts, contact the McCamish Law Firm.  We will help you work within the law to successfully deal with debtors and collect what you are owed.  The firm is based in San Antonio and serves the surrounding communities throughout South and Central Texas.

FIDUCIARY LITIGATION

When two or more people own a business, everyone involved has a legal obligation to act in the company's best interests. This is known as fiduciary duty. When one partner fails to live up to that duty, such as by misusing company funds for personal benefit, that is called a breach of fiduciary duty. Such breaches can cost your business greatly, ruin your reputation and lead to difficult partnership disputes.

Proving breaches of fiduciary duty can be highly complex. The McCamish Law Firm has investigated numerous cases of fiduciary breaches. The firm will build a compelling case and do what is necessary to resolve the dispute.  The firm is based in San Antonio and represents clients throughout South and Central Texas who are dealing with fiduciary litigation.
